Recent patent infringement/false patent marking cases filed in the Eastern District of Texas

  • RPost Holdings Inc. et al v. Adobe Systems Inc. et al.

    The plaintiffs are RPost Holdings Inc., RPost Communications Ltd. and RMail Ltd.

    The defendants are Adobe Systems Inc. and Echosign Inc.

    The defendants are accused of infringing on:

  • U.S. Patent No. 7,707,624 issued April 27, 2010, for System for and Method of Proving the Transmission, Receipt and Content of a Reply to an Electronic Message;
  • U.S. Patent No. 7,865,557 issued Jan. 4, 2011, for System and Method for Verifying Delivery and Integrity of Electronic Messages; and
  • U.S. Patent No. 7,966,372 issued June 21, 2011, for entitled System and Method for Verifying Delivery and Integrity of Electronic Messages.

    The plaintiffs are asking for the court to issue an injunction to prevent further infringement and for an award of damages, costs, expenses, interest, enhanced damages and attorneys' fees.

    The plaintiffs are represented by Winston O. Huff of Navarro Huff in Dallas.

    A jury trial is requested

    Callpod is an Illinois corporation with its principal place of business in Chicago.

    The defendants are T Technology Inc., GN Netcom A/S, GN Netcom Inc. and Hello Direct Inc.

    The defendants are accused of infringing on U.S. Patent No. 7,707,250 issued April 27, 2010, for Wireless Communications Connection Device.

    The plaintiff is asking the court to issue an injunction to prevent for infringement and for an award of damages, interest, attorney's fees and court costs.

    Internet Communications Solutions LLC is a Texas limited liability company with its principal place of business in Frisco.

    The defendants are MagicJack Volcaltec Ltd., Tmax Corp., Tmax Communications Corp., MagicJack LP, VocalTec Communications and Tiger Jet Networks Inc.

    The defendants are accused of infringing on U.S. Patent No. 7,924,825 issued April 12, 2011, for System for Providing Portable VOIP Services.

    The plaintiff is asking the court for an award of damages, costs, interest and attorney's fees.

    Personal Audio is a Texas limited liability company

    The defendant is accused of infringing on U.S. Patent No. 6,199,076, issued March 6, 2001, for Audio Program Player Including a Dynamic Program Selection Controller.

    The products at issue include iPod Nano Generation 6, iPod Shuffle Generation 4, iPod Touch Generation 4, iPhone 4 and iPad 2.

    Personal Audio is asking the court to issue a permanent injunction to prevent further infringement and for an award of damages, treble damages, interest, court costs and attorney's fees.
