Capital One has filed suit against Beaumont resident Roberto Torres, seeking to collect more than $44,000 on a delinquent auto finance account.

The suit was filed Aug. 18 in Jefferson County District Court.

According to the lawsuit, Capital One asserts the defendant entered into an auto finance agreement with the bank.

The suit says the defendant has ceased making payments on the account, thereby creating a default.

On April 26 Capital One sent a letter demanding payment but the defendant still refuses to repay the debt.

The amount of the unpaid loan balance is $34,664.73. Interest accrued is $9,996.73.

Capital One is suing for actual damages, interest court costs and attorney's fees.

Carrollton attorney Michael Scott represents the lender.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
