SHERMAN - A white supervisor has filed a racial discrimination lawsuit against his employer, claiming he was demoted for no reason and replaced by a less experienced African-American employee.
Jimmy Kirby filed suit against Lone Star Reel Corp. on Aug. 29 in the Eastern District of Texas, Sherman Division.
Kirby was employed by the defendant for approximately four years and by its predecessor company, Coon Rod Reel, for approximately 21 years. In October 2010, Kirby was told that he was being suspended from his position as production manager and no explanation was given for his suspension.
A few days later, he was offered to return to work in a new position in the stock room at a lower pay. By the end of the month, Kirby was discharged from his new position, allegedly because an employee was injured on the job while under Kirby's supervision.
The defendant is accused of age and racial discrimination in violation of Kirby's civil rights.
The plaintiff is seeking damages for mental anguish, punitive damages, attorney's fees, court costs, interest.
Kirby is represented by Sherman attorney Ronald R. Huff. A jury trial is requested.
U.S. District Judge Richard A. Schell is assigned to the case.
