Suit claims driver had no valid license

GALVESTON - After sustaining injuries in two-vehicle accident in League City almost two years ago, Harris County resident Hugo Trevino has filed a lawsuit.

According to court documents filed Sept. 22 in Galveston County District Court, a vehicle driven by Maria Guerrero of Texas City struck the back of Trevino's in the 200 block of the Gulf Freeway on Oct. 1, 2009.

The plaintiff says he was driving the vehicle for his employer at the time of the collision, and states he slowed for traffic when Guerrero rear-ended him.

"The defendant, Maria Guerrero, was driving without a valid driver's license," the original petition says.

"Further, the defendant, Maria Guerrero, was cited at the scene for failing to control (her) speed and driving without a valid driver's license."

Trevino claims the accident in question left him "with a lumbar sprain/strain, cervical sprain/strain, bulging discs at C4-5 and C5-6 and herniated discs at L3-4 and L5-S1 with radiculopathy."

"The plaintiff continues to suffer bouts of pain and discomfort in his lower back, neck, shoulders and legs, which affects his ability to perform his job and everyday tasks at home," the suit says.

Silva Santana, also of Texas City, is named a co-defendant in the case because she is the owner of the vehicle which reportedly hit Trevino.

Consequently, the plaintiff seeks unspecified monetary damages and a jury trial.

He is represented by The Manginello Law Firm.

Galveston County 405th District Court Judge Wayne Mallia is presiding over the case.
