Webster resident sues over wreck at BP facility

GALVESTON - Webster resident Dwayne Bobb is seeking $550,000 over injuries he received in a wreck at BP's Texas City refinery.

Bobb's suit, filed Nov. 14 in Galveston County District Court, alleges that on Aug. 6 a BP employee rear-ended a vehicle in which Bobb was a passenger.

"While stopped at a stop sign, the plaintiff's vehicle was suddenly struck from behind by a vehicle being driven by a BP employee," the original petition says.

"The BP employee failed to maintain his speed and keep a proper lookout, and thus, rear-ended the plaintiff's vehicle."

The suit states "the force of the impact instantly caused the plaintiff to suffer neck and back pain," which was later discovered to be whiplash.

Company physicians ordered Bobb to take the rest of the day off and return to work the following Monday, but Bobb "was unable to perform his job duties due to the pain," the suit says.

He again went to the BP medical facility and was told to see another doctor.

The physician with his employer's workers' compensation network determined that he had suffered a back sprain and trauma to the spine and back, and gave him some pain medication.

Bobb states he sought outside medical treatment at San Jacinto Methodist Hospital and later Baytown Back Pain and Health Center, adding "he continues to suffer from mild neck and back pain to this day."

A jury trial is requested.

Chad Pinkerton of the Pinkerton Law Firm is representing Bobb.

Galveston County 405th District Court Judge Wayne Mallia is presiding over the case.
