The plaintiff who filed a lawsuit against family members for running up his credit cards says there are inaccuracies in the coverage of his lawsuit.
On Feb. 14, 2011, Matthew McMahon filed suit in Galveston County Court at Law No. 2 against Eugene V. McMahon of Webster and Darlene L. Marzouk of Dickinson, alleging they incurred numerous charges for which they refuse to pay.
The Southeast Texas Record reported on Feb. 23, 2011, that McMahon was claiming "his parents owe him about $26,000."
In correspondence with the Record, McMahon said he was suing only his "former step-mother," Darlene Marzouk, for an unspecified amount.
McMahon contacted the Record after the story was picked up by the Center for Individual Freedom website and given a new headline, "A Not-So-Happy Mother's Day."
McMahon claims Marzouk racked up numerous charges on his credit card which she refuses to pay. He claims she approached him about using his low-interest credit cards and he agreed only after she promised to pay all charges and indemnify him.
In a recent email to the Record, McMahon wrote that he "has proof that all the charges were related to expenses that benefitted her: property tax payments on her property, mortgage payments on her house, car payments on her Lexus, etc."
According to Marzouk's original answer to the lawsuit, she did not make any representations to McMahon that she would pay for any charges on his credit cards.
The case was originally set for trial on Dec. 5, but has been reset for the parties to attend mediation.
Attorney David J. Salinsky of Houston is representing McMahon.
Marzouk is represented by James T. Fletcher of Friendswood.
Galveston County Court at Law No. 2 Judge Barbara Roberts is presiding over the case.
