$45K agreed judgment reached in breach of contract suit
A trucking company has reached an agreed judgment in its suit against a contractor that allegedly did not pay for dirt supplied for a school construction project.
LSJ Trucking sued Boyette Construction in June 2010, claiming Boyette hired it to provide dirt for the West Orange-Cove Independent School District elementary school construction project in Orange.
Court records show that on Dec. 5 an agreed final judgment was filed in the case, awarding $45,857.50 as the principal amount dues, $1,750 for attorney's fees and $342.97 in court costs.
Previously, on Aug. 22, LSJ attorney Bruce Gregory sent a letter to the court requesting that the case be placed on the first available non-jury trial docket.
According to the suit, after providing the dirt, LSJ sent Boyette invoices totaling $48,487 for materials it delivered to the work site in November 2008.
However, Boyette never paid for the materials, the suit states.
Judge Donald Floyd, 172nd District Court, presided over the case.
