Slippery stairs results in suit against Total Petrochemicals USA

Alleging the stairs he slipped on were unreasonably slippery, Earl Schram has filed suit against Total Petrochemicals USA and Modular Space Corp.

The suit was filed Jan. 6 in Jefferson County District Court.

According to the lawsuit, on May 6, 2010, Schram, a Triple S. Industrial employee, was working at Total's premises. While exiting a Modular Space office, he slipped on the stairwell and fell.

"The stairway was unreasonably dangerous as the grit surface had worn smooth and the stairs stayed wet during the morning hours," the suit states, adding that the defendants owed Schram a duty to protect him from the dangerous condition.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney Tom Oxford of Waldman Smallwood represents him.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
