Gillespie Lumber seeks to transfer wrongful death suit

Next month Gillespie Lumber will argue that a wrongful death case filed in Jefferson County belongs in Nacogdoches County.

According to the complaint filed May 23 in Jefferson County District Court, plaintiff Stacy Weaver claims Robert L. Weaver was killed while riding in a vehicle owned by Gillespie Lumber on May 20 when the vehicle crashed.

Court records show that on Dec. 5 Gillespie Lumber filed an amended motion to transfer venue, asserting it is a Nacogdoches company and that the incident did not even occur in Jefferson County.

A hearing on the matter has been slated for Feb. 24, according to a notice of hearing filed Jan. 6.

Robert L. Weaver leaves behind a minor daughter, Taylor Nicole Weaver, who Stacy Weaver filed the suit on behalf of. Because of her father's death, Taylor Nicole Weaver suffered mental anguish and lost her dad's society, consortium, love, companionship and inheritance, the suit states.

Paul Ferguson Jr. of Provost and Umphrey Law Firm in Beaumont represents her.

The case is assigned to Judge Gary Sanderson, 60th District Court.
