A man has filed suit against the owner of a Port Arthur property where he claims he lost his eyesight after falling in a hole in the parking lot.
Frank Patillo claims he had volunteered to watch defendant Lola Higgins's children at her house on 11th Street in Port Arthur when he fell in a deep hole in the parking area.
Because of his fall, Patillo lost his eyesight, suffered face injuries and incurred medical costs, the suit states.
He also experienced physical pain, suffering, mental anguish and physical impairment; lost earnings and his earning capacity; and sustained disfigurement, the complaint says.
Patillo blames Higgins for contributing to his injuries, saying she negligently failed to provide him with warnings of the unsafe condition, failed to provide adequate lighting and failed to correct the hazardous condition of the parking lot.
In his complaint, Patillo is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.
