A Jefferson County man claims he sustained injuries when a driver made an improper turn and struck his vehicle.
Edgar Ramirez filed a lawsuit Jan. 30 in Jefferson County District Court against Epifanio Herrera Tovar.
In his complaint, Ramirez claims he was driving east on State Highway 87 in Port Arthur on Nov. 26, 2010, when defendant Tovar, who was driving a Chevrolet Silverado, attempted to make an illegal turn from the center lane of the highway into a parking lot. Instead, Tovar struck Ramirez's vehicle, according to the complaint.
Because of the collision, Ramirez incurred medical costs, incurred property damages and lost his earnings and his earning capacity, the suit states. In addition, he sustained physical pain, mental anguish and physical impairment, the complaint says.
Ramirez blames Tovar for causing the collision, saying he negligently made a right-hand turn when it was not safe to do so.
In his complaint, Ramirez seeks damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.
Clay Dugas and Mike Jacobellis of Beaumont will be representing him.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
