Man claims physical, mental injuries from crash

A Jefferson County man has filed suit against the driver who he claims struck his vehicle.

Armstead Holmes Jr. claims he was driving in Jefferson County on Dec. 29, 2010, when defendant William Thomas Speaks Jr. collided with his vehicle.

Because of the collision, Holmes incurred medical costs, experienced physical pain and suffering and sustained mental anguish, according to the complaint filed Feb. 3 in Jefferson County District Court. He also lost earnings, sustained physical impairment, incurred medical costs, sustained physical impairment and incurred property damages, the suit states.

Holmes blames Speaks for causing the collision, saying he negligently failed to keep a proper lookout, failed to maintain control of his vehicle, drove too fast, failed to apply his brakes in a timely manner, failed to exercise ordinary care, failed to turn his vehicle to avoid a collision and failed to keep a safe distance between his vehicle and Holmes.

In his complaint, Holmes is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
