A Hillister man has filed suit against his insurance company, seeking reimbursement for damages he claims he sustained during a collision.
Willie Mayo claims he was driving his truck south on Highway 69 in Hardin County on May 29, 2010, when Trinity Jones suddenly emerged from a side road and into his path. The two vehicles collided, according to the complaint filed Feb. 23 in Jefferson County District Court.
Because of the collision, Mayo incurred medical costs, experienced physical pain and suffering, lost his earnings and sustained disfigurement, the suit states. In addition, he incurred property damages of $4,459.05 and experienced mental anguish, the complaint says.
Following the collision, Mayo claims he sought reimbursement for his damages from Jones's insurance company. He received $18,500, but says it is not enough to pay for his total damages.
At the time of the accident, Mayo had insurance with defendant Home State County Mutual Insurance. The policy should have covered Mayo in case he sustained injuries in a collision with an under insured driver.
In his current complaint, Mayo seeks a judgment within the jurisdictional limit of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.
