Discovery underway in suit claiming shopper struck by rolling dolly

Discovery is underway in a suit claiming a rolling dolly injured a shopper.

Port Arthur resident Jennifer McLain filed suit against Adelle Samora and fashion retailer Citi Trends on Nov. 30 in Jefferson County District Court for injuries she received while shopping for hair accessories.

On March 15 McLain filed a certificate of written discovery, showing Samora had been served with McLain's first set of interrogatories and requests for production and disclosure, court records show.

The suit alleges McLain was shopping at Citi Trends on Oct. 8. While looking at a rack filled with headbands, store employee Samora allegedly struck her in the head with a dolly carrying heavy boxes.

McLain asserts that she was focused on the headband rack and did not hear or see the dolly coming toward her.

She also maintains Samora admitted she was at fault afterwards and that she should have been paying attention to her path of travel, the suit states..

The suit alleges the defendants failed to warn McLain of the impending danger.

McLain is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Port Arthur attorney Langstan Adams represents her.

Houston attorney Dean Solomon represents Samora.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
