Harris County woman sues over collision

A Harris County woman has filed suit against the driver she claims struck her vehicle.

Maria Maldonado Barnes claims she was driving on Jan. 12 when defendant Robert Blain Stewart struck her vehicle.

Because of the collision, Barnes experienced physical pain and mental anguish, lost earnings, endured an impaired earning capacity and sustained disfigurement, according to the complaint filed March 27 in Jefferson County District Court. She also incurred medical costs, lost her household services and incurred property damages, the suit states.

Barnes blames Stewart for causing the collision, saying he negligently failed to maintain a proper lookout, failed to control his vehicle, failed to timely apply his brakes, drove too fast and failed to yield the right-of-way.

In her complaint, Barnes is seeking actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

The case has been assigned to Judge Bob Wortham, 58th District Court.
