Insulation company sues to recoup $70,000 in services

An insulation company claims it lost more than $70,000 after two businesses failed to pay for its services.

Orbital Insulation Corp. filed a lawsuit April 3 in Jefferson County District Court against U-Krane Inc. and American Crane and Rigging.

In its complaint, Orbital alleges the defendants hired it to provide insulation, scaffolding and duct work services from April through September 2011. Orbital has invoiced the defendants for the work it provided, but has not been fully reimbursed, according to the complaint.

"Plaintiff, Orbital, would show that after all offsets and credits, the Defendants, U-Krane and its parent, American Crane and Rigging, are indebted to Orbital in the total sum of $76,360.53," the suit states.

Orbital alleges the defendants breached their contract by failing to pay for the plaintiff's services.

In addition to the money Orbital says the defendants owe it, the company seeks pre- and post-judgment interest at the highest rate, attorney's fees, costs and other relief the court deems just.

James E. Wimberley of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur will be representing it.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
