Debt collector sued for not paying bond with Texas Secretary of State

SHERMAN - A Denton County resident has filed a lawsuit against a debt collector who attempted to collect on an outstanding debt before the company paid the appropriate fees with the Texas Secretary of State.

Claiming violations of the Fair Debt Collection Act, Shawanda Harris filed suit against Mid Continent Credit Services Inc. on May 2 in the Eastern District of Texas, Sherman Division.

The defendant is accused of illegally attempting to collect a debt before it has filed a bond with the Texas Secretary of State. Texas requires debt collectors to file a $10,000 bond before they can collect in Texas.

Harris claims that the defendant's conduct has caused her to suffer great emotional and mental pain and anguish.

The plaintiff is seeking an award of actual and statutory damages, court costs, and attorney's fees.

Harris is represented by Hurst attorney Dennis McCarty. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
