Seaman non-suits Genesis Energy

Plaintiff Daniel Battaglia, who sued Genesis Energy after he sustained injuries due to a vessel's unseaworthiness, has non-suited the company from his Jones Act suit.

As previously reported, the suit was filed July 5 in Jefferson County District Court.

Court records show that on Jan. 26, Battaglia filed a notice of non-suit as to defendants Genesis and DG Marine Transportation.

The following day, Judge Milton Shuffield, 136th District Court, dismissed the defendants without prejudice.

The lawsuit alleges that on March 5, 2011, Battaglia was employed by Genesis serving aboard the vessel MV Clay Griffin when he sustained injuries to his neck, elbow and arm.

Battaglia claimed Genesis negligently failed to train and supervise its employees.

He was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, lost wages and disfigurement, plus all court costs.
