Suit claims dealership withheld prior wreck history of Mercedes

GALVESTON - Harris County resident George Parnham is suing a local auto dealership over a vehicle he claims sustained damages prior to his purchase in February 2009, recent court documents say.

A lawsuit filed May 30 in Galveston County District Court says A-Rod LP, doing business as Alex Rodriguez Mercedes Benz in League City, misrepresented to Parnham that his 2007 Mercedes Benz SL550 was "a certified pre-owned automobile free of any major defects."

Parnham states the defendant did not inform him that the vehicle had been involved in a previous major collision. He claims he learned of the car's true history during a visit to a body shop.

According to the complaint, Parnham claims he contacted the defendant, which sent the salesperson who conducted the transaction to the shop to conduct an investigation.

The suit alleges the salesperson told the owner and one of the mechanics that the car in question was not the one he sold to Parnham, and added the plaintiff had changed the rims.

According to the original petition, the statements were "completely false" and the salesperson "was apparently attempting to cover up the fact that a damaged vehicle had been sold to the plaintiff."

Parnham says he suffered approximately $13,000 in actual damages.

He is represented by attorney Joe S. Maida of Houston.

The case has been assigned to Galveston County 56th District Court Judge Lonnie Cox.
