Denton County woman sues debt collector over early morning phone calls

SHERMAN - After receiving several early morning telephone calls, a Denton County woman has filed a lawsuit against the debt collector for using unfair practices.

Claiming violations of the Fair Debt Collection Practices Act, Nicole Tommarazzo filed suit against Asset Acceptances on June 5 in the Eastern District of Texas, Sherman Division.

Tommarazzo states that the defendant placed calls to her cellular phone at inconvenient times, like before 8 a.m. She argues that the defendant's actions are highly offensive.

The Fair Debt Collection Practices Act prohibits debt collectors from using abusive, deceptive, and unfair practices.

The plaintiff is asking the court to prevent the defendant from continuing its violative behaviors and for an award of statutory damages, actual damages, attorneys' fees, court costs, and interest.

Tommarazzo is represented by Dennis R. Kurz of Weisburg & Meyers in Houston. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
