Suit filed over wreck on Highway 90

A Beaumont man has filed suit against the driver who he claims struck the vehicle in which he was riding.

Phillip Burrows claims he was riding in a vehicle Staci Ann Marks was driving west in the 5000 block of U.S. 90 in Beaumont on June 28, 2010, when May Cochran Monts pulled out of a private drive, failed to yield the right-of-way and struck Marks's vehicle.

Because of the collision, Burrows incurred medical costs and experienced physical pain, suffering and mental anguish, according to the complaint filed June 6 in Jefferson County District Court.

May Cochran Monts negligently failed to keep a proper lookout, failed to take evasive action to avoid the collision, failed to yield the right-of-way and failed to apply her brakes to avoid the collision, the suit states.

In his complaint, Burrows is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre- judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

Thomas O. Moses of Beaumont will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
