MARSHALL - A Marshall man has filed a lawsuit against a Louisiana company after he was involved in a wreck allegedly caused when the company's driver failed to yield the right of way.
Gary Keasler filed suit against Stringer Contracting Inc. on June 12 in the Eastern District of Texas, Marshall Division.
The accident occurred on Jan. 14, 2011, in Harrison County as Hector L. Leal-Ramirez was driving a truck with a utility trailer attached, which was owned by Stringer Contracting.
According to the lawsuit, Keasler was traveling east in the 500 block of Cox Road and Leal-Ramirez failed to yield the right of way by starting out on the roadway from a private driveway. Defendant's vehicle struck Keasler's vehicle.
The defendant is accused of negligence for failing to keep a proper lookout, failing to make timely and proper application of the brakes, and for violating provisions of the Texas Transportation Code.
The plaintiff is asking the court for an award of damages for pain, mental anguish, physical impairment, lost wages, loss of wage earning capacity, medical expenses, interest and court costs.
Keasler is represented by Marshall attorney Jim Ammerman II.
U.S. District Judge Rodney Gilstrap is assigned to the case.
