Woman sues man who couldn't avoid load spilled on road

Alleging she was injured in an automobile collision, Cynthia Mathis is suing Matthan Rich, who stopped in the road after a load spilled from a vehicle owned by Brian Burrows – also a defendant in the suit.

The suit was filed July 3 in Jefferson County District Court.

According to the lawsuit, on Sept. 16, 2011, Burrows allegedly failed to properly secure a load to his vehicle. When the load spilled, Rich was forced to stop. As Mathis came upon the scene, she was unable to avoid striking Rich.

The collision sent her vehicle over the guardrail. Mathis suffered a fractured wrist and broke every bone in her face.

The suit accuses Rich of negligently failing to keep a safe distance and failing to reasonably avoid the spilled load. Burrows is accused of failing to properly secure and transport equipment in his vehicle.

The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Houston attorney Kurt Arnold of Arnold & Itkin represents the plaintiff.

Judge Bob Wortham, 58th District Court, is assigned to the case.
