GuardTech Pest Management dismissed from infestation lawsuit

Earlier this year, GuardTech Pest Management was dismissed from a lawsuit alleging it failed to detect a termite infestation, which ended up causing thousands of dollars worth of damage.

As previously reported, Groves residents Michael and Stacy Migues filed suit against GuardTech on Nov. 9, 2010, in Jefferson County District Court.

Court records show that on Jan. 17 Judge Donald Floyd, 172nd District Court, granted a motion to dismiss GuardTech without prejudice.

The plaintiffs had filed the motion to dismiss on Oct. 19, stating that they no longer wished to pursue their claim.

The lawsuit alleged that GuardTech performed an inspection of the plaintiffs' Groves home and allegedly "missed an active termite infestation, causing damages totaling $9,000."

The Migueses were suing for actual damages.

Beaumont attorney John Morgan represented them.

GuardTech was represented by attorney Frank Calvert of the Beaumont law firm Calvert, Eaves, Clarke & Stelly.
