Woman rear-ended while waiting for truck to move

A Jefferson County woman has filed suit against the truck driver who she claims caused her to stop driving in the middle of the road and the driver who rear-ended her as she waited for the truck driver to move.

Victoria Franks claims she sat at a complete stop, waiting for defendant Cody Wayne Stephenson to manipulate the truck he was driving for defendant AAA Cooper Transportation out of a driveway on May 24.

As Franks waited, defendant Christopher Shane Myers failed to control his speed and struck the back of her vehicle, according to the complaint filed July 12 in Jefferson County District Court.

Because of the collision, Franks experienced physical pain and mental anguish, incurred medical costs and sustained physical impairment, the suit states. She also lost wages, the complaint says.

Franks blames Myers for causing the collision, saying he negligently failed to timely apply his brakes, failed to maintain a proper lookout, failed to turn to avoid a collision, drove too fast, failed to pay attention and failed to control his speed.

Stephenson is also named as a defendant for his failure to keep on his emergency lights, according to the complaint.

Franks is seeking a judgment, plus pre- and post-judgment interest, costs and other relief the court deems just.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
