Wells Fargo sues debtors for breach of contract

Wells Fargo Bank has filed a breach of contract suit against Beaumont residents Patrick and Katrina Vaughn, alleging the couple has defaulted on a credit card account.

The suit was filed Aug. 13 in Jefferson County District Court.

According to the petition, the couple executed a credit card customer agreement with Wells Fargo in the original amount of $9,850, which they first accessed on Oct. 17, 2001.

"The account provided for defendants to make payments to plaintiff of all principal and interest," the suit states. "Defendants failed to abide by the terms of the account by failing and refusing to make payments," the suit states.

The suit accuses the defendants of breach of contract and unjust enrichment.

The plaintiff seeks recovery of the entire unpaid balance and accrued interest, plus attorney's fees.

Attorney Mark Rechner of the Dallas law firm Vincent Lopez Serafino Jenevein represents the plaintiff.

Judge Bob Wortham, 58th District Court, is assigned to the case.
