TYLER - Three electricians have a filed a federal lawsuit that claims their Tyler employer violated federal law by failing to pay wages for the time they spent preparing and traveling to the jobsite.
Claiming violations of the Fair Labor Standards Act, Scott Hughes, James Marshall and James Rinehart filed suit against D&S Electric Services Inc. on Aug. 16 in the Eastern District of Texas, Tyler Division.
Hughes, Marshall and Rinehart were employed as hourly-paid apprentice electrician, journeyman and electricians for the defendant.
According to the lawsuit, the employees were required to go to the shop or supply house before and after working at the jobsite. The men claim they were not compensated for any time worked other than at the job site.
The defendant is accused of violating the Fair Labor Standards Act by failing to pay overtime compensation.
The workers are asking for an award of damages for overtime compensation for all unpaid hours worked in excess of forty hours, liquidated damages, attorney's fees, interest and court costs.
The plaintiffs are represented by Jeremi K. Young and Rhonda Luginbyhl of The Young Law Firm P.C. in Amarillo.
U.S. District Judge Michael H. Schneider is assigned to the case.
