While walking on the sidewalk near a Wal-Mart garden center, Angela Barnett, a Beaumont local, tripped over a utility cord.
On Aug. 17 Barnett filed suit against Wal-Mart Stores Texas in Jefferson County District Court, alleging the supercenter owed her a duty to warn her of the dangerous condition.
According to the lawsuit, on May 19 Barnett was at the Beaumont Wal-Mart when she tripped over a utility cord running across a sidewalk by the store's garden center, falling and injuring her knee.
Barnett required knee surgery following the incident, the suit states.
The suit accuses Wal-Mart of negligently failing to inspect and maintain its premises and warn customers of dangerous conditions.
The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Houston attorney Dan Kirby represents her.
Judge Bob Wortham, 58th District Court, is assigned to the case.
