Petition seeks testimony to obtain identity of Kirkland's employee

Injured Hardin County resident Rachel Clark has filed a petition to take depositions before a suit, seeking the testimony of an individual who may able to identify a Kirkland's employee with firsthand knowledge of her injury.

The petition was filed Aug. 16 in Jefferson County District Court.

According to the petition, the potential claim at issue surrounds an incident that occurred on May 14 at the Beaumont Kirkland's.

Clark is seeking an order from the court authorizing the deposition of Billy Hopper in order to elicit testimony regarding the identity of a store employee who assisted Clark in purchasing a product.

"Petitioner believes this witness has firsthand knowledge of such facts," the petition states, adding that Clark anticipates initiating an action for recovery of damages for injures she suffered.

The petition does not state what injuries Clark suffered or how the incident occurred.

She is represented by Beaumont attorney Ryan Schaper of the Provost Umphrey Law Firm.

Judge Bob Wortham, 58th District Court, is assigned to the case.
