Man says crash due to woman's failure to stay in lane

A man has filed suit against the driver who he claims failed to drive in a single lane, causing a collision.

Ted Brack claims he was driving east on U.S. Highway 90 on Feb. 26 when suddenly defendant Kahlia Christina Freese, who was driving in the same direction, failed to stay in her lane and struck his vehicle.

Because of the collision, Brack incurred medical costs; lost earnings; and experienced physical pain, mental anguish, physical impairment and physical disfigurement, according to the complaint filed Aug. 16 in Jefferson County District Court.

Freese negligently failed to maintain a proper lookout, failed to maintain control of her vehicle, failed to control her speed, failed to timely apply her brakes, failed to take evasive action to avoid a collision and failed to use reasonable care, the suit states.

In his complaint, Brack is seeking actual and punitive damages, plus costs, pre- and post-judgment interest at the highest legal rate and other relief the court deems just.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
