Shopper sues Wal-Mart after tripping over unsecured rug

SHERMAN - A Wal-Mart shopper has filed a lawsuit that claims she was injured when she tripped and fell when her shoe got caught on an unsecured rug.
Denise Lynn Cullum filed suit against Wal-Mart Stores Texas and Paula Stover on July 20 in Collin County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on Aug. 22.

The incident occurred on July 9, 2011 as Cullum was entering the Wal-Mart store in Wylie.

According to the suit, Cullum alleges she tripped and fell as her shoe got caught on a rug that had been flipped over and not properly secured to the floor.

Wal-Mart is accused of failing to institute policies to protect customers from dangerous conditions, failing to train its employees and for failing to warn customers that such dangerous conditions existed.

The defendants generally deny the allegations.

The plaintiff is seeking damages for medical expenses, physical pain and mental anguish, physical impairment, scaring and disfigurement, interest and court costs.

Cullum is represented by Anjel K. Avant of Avant Law Firm in Richardson.

U.S. District Judge Ron Clark is assigned to the case.
