Jefferson Co. couple says insurance company refuses to pay damages

Two Jefferson County residents claim an insurance company refuses to pay them for damages they sustained in a collision.

Ty Warner as next friend of Brenna Warner as assignee of Edith Hart filed a lawsuit Sept. 21 in Jefferson County District Court against Security National Insurance Co., doing business as Bristol West Specialty Insurance Co.

In his complaint, Ty Warner alleges Edith Hart was driving a 2001 Chevrolet Tahoe eastbound in the westbound lanes of the 2600 block of West Highway 73 in Port Arthur. Suddenly, Hart struck Brenna Warner’s vehicle, according to the complaint.

The vehicle Hart drove was supposed to be covered by an insurance policy issued by defendant Security National Insurance Co., doing business as Bristol West Specialty Insurance Co. However, when Brenna Warner attempted to collect money from Bristol, her settlement offer was rejected, the suit states.

In a previous lawsuit, the Warners obtained a judgment against Hart for costs associated with the collision. Now, they are coming after her insurance company to pay them for damages that Hart’s insurance policy should have covered, the complaint says.

In their complaint, the Warners seek an unspecified judgment, plus costs, pre- and post-judgment interest and other relief the court deems just.

Tommy L. Yeates of Moore Landrey in Beaumont and Richard G. Lewis of Boneau and Lewis in Port Arthur will be representing them.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
