Alleging the Fusion she bought is a lemon, Nederland local Wendy Mullins is suing Ford Motor Company.
The suit was filed Oct. 1 in Jefferson County District Court.
According to the lawsuit, on Oct. 18, 2011, Mullins purchased a Ford Fusion for $20,975. The vehicle was covered by a three-year or 36,000 mile warranty.
She brought the vehicle back to the seller complaining of a defective engine/electrical system as evidenced by a no start condition.
Despite a numerous amount of attempts, the dealership failed to repair the vehicle.
On Aug. 9 Mullins revoked acceptance of the Fusion. However, Ford refused her demand for revocation.
“Plaintiff has been and will continue to be financially damaged due to defendant’s failure to comply with the provisions of its written warranty and its failure to provide plaintiff with a merchantable fusion,” the suit states.
Mullins is suing for actual damages and attorney’s fees.
Georgetown attorney Robert Kiddie of Krohn & Moss represents her.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
