Man wants insurance company to pay for damages in collision

A Beaumont man wants his insurance company to pay for damages he incurred in a collision with an under insured driver.

John Michael Falgout filed suit Oct. 10 in Jefferson County District Court against Melissa Laura Sidwell and United Services Automobile Association.

Falgout claims he was involved in a collision with Sidwell on Chadbourne Lane near its intersection with Avenue R in San Angelo on Feb. 9, 2011.

Because of the accident, Falgout incurred property and medical costs; lost his earning capacity; and sustained physical pain, mental anguish, physical impairment and physical disfigurement, according to the complaint.

At the time of the collision, Sidwell lacked sufficient insurance coverage to compensate Falgout for his damages. He is asking his insurance company to make up for those costs, the suit states.

In his complaint, Sidwell seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the legal rate, costs, punitive and exemplary damages and other relief the court deems just.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
