Discovery ongoing is suit over sale of Gator Stop No. 4

Discovery is still ongoing in a suit brought over the sale of a convenience store.

As previously reported, Burton Mart Inc. filed suit against Shujat Holding Co. on June 19 in Jefferson County District Court, alleging the defendant sold a convenience store to the plaintiff but never tendered the property.

Court records show that the latest certificate of discovery was filed on Sept. 11, which contained the defendant’s response to plaintiff’s request for disclosure.

The lawsuit alleges that the parties entered into an agreement for sale of Gator Shop No. 4, located in Port Neches.

“After plaintiff paid and provided substantial consideration to defendant, defendant refused to tender the property to defendant,” the suit states.

Burton Mart claims Shujat Holding breached its contract and committed fraud.

The plaintiff is suing for actual and exemplary damages.

Beaumont attorney Chris Portner of Portner Bond represents it.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
