A man and his wife have filed suit against the driver who they claim failed to yield the right-of-way, causing a collision.

In his complaint, Arthur Doug McMakin claims his wife, Brenda McMakin, was driving his vehicle in Beaumont on March 16, 2012, when defendant Betty Galassi failed to yield the right-of-way and struck the automobile.

Because of the collision, Brenda McMakin experienced physical pain, suffering and mental anguish, according to the complaint filed Nov. 1 in Jefferson County District. Arthur Doug McMakin incurred property costs, the suit states.

The McMakins blame Galassi for causing the collision, saying she negligently failed to yield the right-of-way, failed to keep a proper lookout, failed to maintain proper control of her vehicle, drove in a reckless manner, failed to timely apply her brakes and failed to turn to avoid the collision.

In their complaint, the McMakins seek actual and exemplary damages, plus pre- and post-judgment interest at the highest rate allowed by law, costs and other relief the court deems just.
