Companies seek $340K payment for delivered asphalt, sue Lowe’s

A pair of asphalt suppliers has filed suit against Lowe’s Home Centers and Chance Construction Co., alleging an invoice of more than $340,000 remains unpaid. 

Paveco and Century Asphalt filed the suit Nov. 28 in Jefferson County District Court.

According to the lawsuit, pursuant to an agreement with Chance Construction, Paveco provided asphalt paving services for a Lowe’s project in Jefferson County.

At the request of Paveco, Century provided asphalt materials.

“Paveco invoiced Chance for the asphalt … delivered,” the suit states. “However, Chance withheld payment.”

The suit accuses Chance of breaching its contract and seeks to recover actual damages in the amount of $341,575.66, plus attorney’s fees.

Houston attorney Phillip Livingston represents the plaintiffs.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
