Recovery of $39K debt sought by Capital One

Capital One National Association has filed suit against Beaumont resident Casey Dishman, alleging she owes more than $39,000 on a delinquent small business credit account. 

The suit was filed Dec. 31 in Jefferson County District Court.

According to the lawsuit, Capital One advancing dollar amounts to the defendant on a credit account that she became obligated to pay.

The suit does not state when the account was opened, but does state that the defendant ceased making payments on the account, thereby creating a default.

On Aug. 1 Capital One claims it sent a letter demanding payment but the defendant still refuses to repay the debt, according to the suit.

As of Dec. 5 the amount due and owing on the account is $39,001.71, the suit states.

“Defendant has presented its claim to defendant for payment, by defendant has failed and refused to pay the amount owed,” the suit states.

Capital One is suing for actual damages, interest court costs and attorney’s fees.

Carrollton attorney Michael Scott represents the lender.

Judge Bob Wortham, 58th District Court, is assigned to the case.
