TYLER - A Smith County man has filed a lawsuit against a Louisiana casino claiming he fell down a flight of stairs because the stairway treads were not properly maintained.
Rickey Vaughn filed suit against Louisiana Riverboat Gaming Partnership, Legends Gaming of Louisiana-1 LLC, Legends Gaming of Louisiana-2 LLC, Legends Gaming LLC, Global Gaming Bossier City LLC, individually and or collectively doing business as DiamondJacks Casino, and DiamondJacks Casino and Resort on Jan. 2 in the Eastern District of Texas, Tyler Division.
The incident occurred on Jan. 21, 2012, as Vaughn was walking down a flight of stairs at DiamondJacks Casino & Resort in Bossier City. Vaughn states that the stairway treads were not maintained and caused him to fall.
The defendants are accused of premise liability, negligence, and negligence per se for failing to properly warn of the unsafe stairway and hazardous conditions on its premises, failing to provide a premises free of foreseeable hazards, failing to inspect and evaluate the design and marking of the stairs, failing to correct the dangerous condition that was created by the absence of a warning sign or lacking maintenance, and for failing to utilize accepted principles of safety engineering and rules of hazard control.
The plaintiff is seeking an award of damages for medical expenses, physical pain, suffering, and mental anguish, loss of earning capacity, disfigurement, physical impairment, interest, court costs, and attorney’s fees.

U.S. District Judge Michael H. Schneider is assigned to the case.
