Geriatric Physicians Management files suit to recover $90K from practice

GALVESTON - Geriatric Physicians Management and Capital Inc. has filed suit against Geriatric Physicians Care P.A. in an effort to recover approximately $90,000, recent court documents say. 

According to a lawsuit filed Jan. 4 in Galveston County District Court, Geriatric Physicians Care owes the plaintiff $92,364 for the termination of a contract between them.

Both parties entered into a revolving promissory note and a management service agreement on July 18, 2010.

The complainant was required to provide business, administrative and management services while the respondent was called upon to remit a monthly payment in the amount of 18 per cent of its gross revenues as well as any other added expenses in accordance to the subject agreement.

Geriatric Physicians Management and Capital notified the defendant via certified mail on Dec. 8, 2011, that it wanted to discuss the latter's request to exit the contract.

In the same correspondence, the plaintiff issued a demand for the funds that are now in dispute to which Geriatric Physicians Care purportedly "failed to acknowledge."

"To date, the plaintiff has not received reimbursement for any of the funds advanced to the defendant nor has the plaintiff received payments for services rendered pursuant to the agreement," the suit says.

It insists the complainant fully performed its contractual obligations.

A jury trial is requested.
