A former maintenance worker has filed a lawsuit against his former employer claiming that he was not paid overtime wages.

Jerry Lee Holland filed suit against John O. Wright on Jan. 10 in the Eastern District of Texas, Beaumont Division.

Holland worked for the defendant from Dec. 1, 2011, through March 1, 2011, and again from April 1, 2012, through July 10, 2012, as a maintenance worker.

According to the suit, during his employment, Holland worked in excess of 40 hours per week and was not paid one and one-half times his regular rate of pay for each overtime hour worked.

The defendant is accused of violating the Fair Labor Standards Act by not paying overtime wages and violating the Texas Minimum Wage Act by failing to pay Holland the federally mandated minimum wage for each hour worked during the workweek.

The plaintiff is asking for an award of damages for all unpaid overtime wages, liquidated damages, out of pocket expenses, court costs, attorney’s fees and interest.

Holland is represented by Charles L. Scalise of Ross Law P.C. in Austin. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
