Plaintiff Farhana Swati recently had her motion for continuance granted in her suit against Ronald Schuler Jr. and his business, Magnolia Cleaners, in which she alleges the defendants sold her Persian rugs.
Swati filed the suit under the Texas Deceptive Trade Practices Act on Nov. 8, 2011, in Jefferson County District Court.
On Nov. 16 she filed a motion for continuance, stating her attorney just had hip replacement surgery, court papers say.
The case had been slated for trial in December.
However, Judge Bob Wortham, 58th District Court, granted the motion on Dec. 13 and reset the case for June 2013, court records show.
The suit states that Swati entrusted Magnolia Cleaners to clean three Persian rugs sometime in February 2011.
“When plaintiff returned to retrieve her rugs, she was notified by the owner that the rugs had been sold to someone else,” the suit states.
“Plaintiff would show there was no notice given to her that her rugs would be appropriated by the owner and sold to other people. Defendant never gave adequate notice of time limits which were reasonable for retrieval of material to be cleaned.”
However, the suit does not state when Swati went to retrieve her rugs or how long the cleaners kept them before selling the items.
