A maintenance worker has filed a premise liability lawsuit against Goodyear claiming that he was injured due to a lack of maintenance on machinery.
Richard Allan Gipson Jr. filed suit against The Goodyear Tire & Rubber Co. on Dec. 14 in Jefferson County District Court. The defendant removed the case to the Eastern District of Texas, Beaumont Division on Jan. 25.
Gipson states he was injured in February 2011 while he was employed by Qualitech Maintenance at a job at defendant’s facility in Jefferson County. He alleges his injuries were due to Goodyear’s failure to provide safety devices and failure to maintain it’s the machinery where the rubber bales were being cut and collected by Gipson.
The defendant is accused of negligence for failing to inspect the premises, failing to correct a dangerous condition, failing to furnish Gipson a safe place to work, failing to warn invitees that this dangerous condition existed and for failing to properly supervise.
The plaintiff is seeking an award of damages for physical pain and suffering, mental anguish, medical expenses, lost reduction of earning capacity, physical impairment, interest and court costs.
Gipson is represented by B. Adam Terrell of Weller, Green, Toups & Terrell in Beaumont. A jury trial is requested.
