MARSHALL - Claiming that the vaginal mesh used to treat her pelvic organ prolapse cannot be completely removed, Shelly R. Terry has filed a lawsuit against American Medical Systems Inc. on Feb. 4 in the Eastern District of Texas, Marshall Division.
Terry was treated at Longview Regional Medical Center in Longview for pelvic organ prolapse in Nov. 19, 2009. The surgeon used the defendant’s Intepro Mesh, an implantable mesh.
According to the suit, Terry states that her condition was not remedied by this procedure and became subsequently worse. In August 2012, Terry underwent disintegration and infection of the mesh, the suit states.
According to the lawsuit, all the mesh could not be excised and therefore, Terry continues to suffer from various infirmaries due to complications.
The defendant is accused of strict liability, negligence and breach of warranty.
Terry is seeking an award of damages for medical expenses, loss of wages, loss of earning capacity, physical impairment, physical pain, mental anguish, loss of enjoyment of life, punitive damages, interest, court costs and attorney’s fees.
The plaintiff is represented by Blake C. Erskine of Erskine & McMahon in Longview and Dan Stroup of Dan Stroup PC in Longview.
A jury trial is requested.
U.S. District Judge Rodney Gilstrap is assigned to the case.
