A settlement has been reached in a wrongful death suit against St. Giles Living Centers which alleged a lack of care caused the death of a 60-year-old mentally disabled patient.
As previously reported, Brenda Pence, Lance King, Jammie King and Krissi Savoy filed the suit on behalf of Dennis King on April 5 in Jefferson County District Court.
Court records show that plaintiffs filed a motion to dismiss with prejudice on Oct. 8, stating the parties have reached a full and final settlement.
Judge Bob Wortham, 58th District Court, granted the motion on Oct. 12.
The suit states that Dennis was a resident at St. Giles. On Dec. 11, 2010, he was transported to a hospital and found to be anemic. The suit says it was determined that Dennis suffered anoxic brain damage. He died the following day at the age of 60.
The plaintiffs alleged the defendants failed to inform them that Dennis was ill, ignored his worsening condition and negligently failed to seek timely medical attention.
The plaintiffs alleged the defendant acted with malice, which they claim entitled them to exemplary damages.
