Highway pileup results in lawsuit against Transit Mix Concrete & Materials

A Jasper County resident is suing two individuals and a company for injuries he suffered in a highway collision. 

Michael Daigle filed suit against Helena Bertrand, Robert Purks and Transit Mix Concrete & Materials on March 26 in Jefferson County District Court.

According to the lawsuit, on Feb. 5 Bertrand was entering eastbound traffic on Highway 73 from US 69 when she lost control of her vehicle, spun around, hit a concrete divider and came to a stop facing traffic on Highway 73.

Daigle slowed to avoid hitting her and was rear-ended by Purks, who was driving a Mack truck owned by Transit Mix Concrete & Materials and in the course and scope of his employment with the company.

The suit accuses both Purks and Bertrand of negligently failing to operate their vehicles in a safe manner.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages,

Beaumont attorney Clay Dugas represents him.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
