Grocery store sued after shopper slips in water from freezers

SHERMAN - A shopper has filed a lawsuit against a grocery store claiming that she suffered serious injuries when she slipped in water that was coming out of box freezers. 

Demetria Sanders filed suit against Kroger Texas LP and M.C. of T. Inc., doing business as Omega, on Jan. 9 in Collin County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on March 29.

The accident occurred on Feb. 18, 2011 as Sanders was shopping at a Kroger grocery store and fell because of a watery liquid emanating from the box freezers.

The defendants are accused of previously working in the area were Sanders fell and knowing about the watery substance on the floor.

“Despite the fact that they caused the water to be on the floor, no warning signs were posted and the liquid was not cleaned up,” the lawsuit states.

After Sanders fell, Kroger placed a “Caution” sign in the area to warn of the wet spot.

According to court records, Sanders injuries required surgery and significant rehabilitation.

The plaintiff is seeking an award of damages for physical pain, suffering, mental anguish, disfigurement, physical impairment, medical expenses, lost wages, loss of earning capacity, unliquidated damages, interest and court costs.
