Man blames injuries on driver who rear-ended his vehicle
A Jefferson County man has filed suit against the driver who he claims rear-ended his vehicle.
Secundino Deleon claims he was driving north in the 3400 block of Twin City Highway on Nov. 3 at about 6 p.m. when he slowed to make a right-hand turn.
As Deleon began to decelerate, defendant Gabino Rodriguez, who was driving behind Deleon, suddenly rear-ended Deleon’s vehicle, causing it to spin and come to a stop facing the opposite direction, according to the complaint filed April 16 in Jefferson County District Court.
Immediately following the collision, Deleon was taken to the hospital, the suit states. He experienced pain, suffering and mental anguish and incurred substantial repair costs due to the damage caused to his vehicle during the collision, the complaint says.
Deleon blames Rodriguez for causing the collision, saying he negligently failed to drive in a safe manner, failed to keep a proper lookout, failed to keep a safe distance and failed to take evasive action to prevent a collision.
In his complaint, Deleon is seeking actual damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
He will be represented by Brenton J. Allison and Douglas T. Gilman of Gilman and Allison in Pearland.
The case has been assigned to Judge Bob Wortham, 58th District Court.
