Driver blamed for causing collision after failing to yield right-of-way at stop sign

Two Port Arthur residents allege they and a minor sustained various injuries after a driver failed to yield the right-of-way at a stop sign. 

Juan Collado and Amy Daniels filed a lawsuit April 8 in Jefferson County District Court against Chinh Vo.

In their complaint, the plaintiffs allege Collado and minor Bernard Daniels were traveling east on Ninth Street in Port Arthur on June 19, 2011, when Vo, who was driving south on Eighth Street, failed to yield the right-of-way at a stop sign and struck their vehicle.

Because of the collision, Collado suffered injuries to his hips, knees and back while Bernard Daniels suffered head, neck and back injuries, according to the complaint. In addition, they experienced physical pain and suffering, endured mental anguish and physical impairment and lost their earning capacities, the suit states. Amy Daniels claims she lost her son, Bernard Daniels’s, services.

The plaintiffs blame Vo for causing the collision, saying he negligently failed to timely apply his brakes, failed to keep a proper lookout, failed to drive in a safe manner, failed to keep control of his vehicle, failed to take evasive action and failed to control his speed.

In their complaint, Collado and Daniels seek an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
