SHERMAN - After suffering a slip-and-fall accident, a Wylie woman has filed a lawsuit against her local Target store claiming that the store failed to place warning signs regarding the presence of the liquid substance on the floor.
Amy Dorsey filed suit against Target Corp., doing business as Target Store #T2550 and/or doing business as Wylie Super Target, on April 1 in Collin County District Court. The defendants removed the case to the Eastern District of Texas, Sherman Division on May 2.
The incident occurred on March 31, 2011, as Dorsey was entering the Target store in Wylie, Texas. She states that she slipped on a liquid substance that was on the floor inside the Target store and fell. According to the lawsuit, there were no warning signs posted.
The defendant is accused of premises liability and negligent activity for failing to exercise ordinary care, failing to warn, creating and causing an unreasonably dangerous condition, failing to use reasonable care in supervising its employees, and for failing to recognize and correct an unreasonably dangerous activity.
The plaintiff is seeking an award of damages for medical expenses, physical pain and suffering, mental anguish, physical impairment, loss of earnings, loss of earning capacity, disfigurement, interest and court costs.
Dorsey is represented by Geoffrey E. Schorr and A. Jared Aldringer of Schorr Law Firm P.C. in Garland. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
